  1. Abbreviated terms: Internet access required. Activity will occur between 15 May 2021 and 24 June 2021, and in this period, both local and global winners will be announced.  Upload your original video, which complies with the instructions herein indicated. There will be 1 overall winner selected out of 4 local winners.

The overall winner’s prizes for South African entrants are:

  • R20 000 per bartender team member (2 pax)

  2. Full terms and Conditions: The following terms and conditions apply to the “Shot ring Competition” (hereinafter the Competition). By entering this Competition, you accept, agree to, and adhere to these terms and conditions. Please keep a copy for your information.
  3. Promoter: PERNOD RICARD MÉXICO, S.A. DE C.V (PRM)., a Mexican company duly incorporated by the laws of Mexico which corporate domicile is at Rio Tiber 29, CuauhtĂ©moc, 06500, Mexico, City, hereinafter referred to as the Promoter.
  4. Eligibility: The Competition is open to residents over legal drinking age in Turkey, Colombia, South Africa and Ukraine (Here after referred as the Participant Countries), excluding employees of the Pernod Ricard group, their immediate families (spouse, father, son, brother, grandfather and / or “adoptive” family) and employees of any agency or any third party directly associated with the dissemination and execution of the Competition;
  5. Internet access is required to enter.
  6. No need to make a purchase.
  7. Registration period: the Competition opens on 15 May 2021. Registration and content uploading must be done by 1  June 2021.

 

  1. How to enter the Competition:
  2. Visit olmecatequila.com/shotring (hereinafter the Platform) follow the instructions provided and upload your video (hereinafter the Content) and provide your name, country of residence and email address in the online form.
  3. Eligible Entries: In order for your Content to be eligible for the Competition, your video must contain:
    1. An Original cocktail recipe (the “Recipes” or individually the “Recipe”) which may be:
      1. Simple (ingredients you can choose in high energy bars or night clubs)
      2. Low ABV recipe with any sku of Olmeca tequila included
  • Recipe shown at the end of the video
  1. Back bar must represent Olmeca identity, and contain bottle visibility
  1. Show at least two (2) people preparing the Recipe in the video. (The Participants)
  2. Do not violate the Content restrictions presented below.
  3. Do not violate the property restrictions listed below.

 

  1. Content restrictions. Contents that in the sole judgment of the Promoter violate any of the following restrictions will not be accepted:
  2. Entries with sexually explicit or suggestive content (for example, nudity or pornography).
  3. Entries with content that promote activities that may appear unsafe or dangerous.
  4. Entries with content that promote, advocate, suggest, endorse, or humorously treat excessive, irresponsible or underage drinking.
  5. Entries that present violent, derogatory, profane, vulgar, indecent, racist, or cruel content, including, but not limited to, words or symbols that may be considered offensive to individuals of any race, ethnicity, religion, sexual orientation, or socioeconomic group;
  6. Entries with content that represents the Promoter or the Promoter’s product brands, which in any way may give rise to public contempt, scandal, discredit or ridicule or that defame, misrepresent or contain derogatory comments about the Promoter, their brands or other people or companies ;
  7. Entries that communicate messages or images inconsistent with the positive images and / or the good reputation associated with the Promoter; or
  8. Entries with content that violates any applicable law or regulation regarding the marketing of alcoholic beverages (for example, the DISCUS Code of Responsible Practice and / or the EFRD Code http://spirits.eu/files/96/marketing-guidelines -spiritseurope.pdf)

 

  1. Property restrictions. Any Content entered must be your own and original work and may not contain, incorporate or refer to anything that is owned by a third party or entity or that requires the consent and / or authorization of any third party or entity in any jurisdiction. This includes:
  2. Trademarks, logos, or trade images (such as apparel, distinctive packaging, or exterior / interior of buildings) owned by third parties;
  3. Any personal identification;
  4. Copyrighted material owned by third parties (including songs, photographs, sculptures, paintings, and other works of art or images posted on websites, television, movies, and other media);
  5. Materials that involve names, likenesses, voices or other indications that identify any person, including without limitation celebrities or public figures, living or dead;
  6. Any other intellectual property right.

 

  1. Participants:
  2. All Participants must be of legal drinking age or older (and if requested you must be able to provide proof of this)
  3. Participants shall subscribe maximum one Content to enter the Competition. If you enter more than one Content, only the first will be accepted and all the others will be disqualified. Entries on behalf of another person will not be accepted.

 

  1. Contents entered must not have been previously presented in any promotion of any kind, nor exhibited or displayed publicly through any medium.

 

  1. The Promoter reserves the right at any time and at its absolute discretion, to:
  2. Verify the eligibility of any Participant or Content uploaded (including their age, place of residence and originality of the Content);
  3. Disqualify any participant who is abusing or manipulating the operation of the Competition or who enters using fraudulent means, or who the Promoter considers having breached these terms and conditions;
  4. Disqualify Content from people who provide creative services to companies that are under the jurisdiction of the Promoter; or
  5. Disqualify Participants who do not provide their correct contact details or those who make their registration on behalf of another person.

 

  1. Winner Selection

 

  1. Local Winner Selection: The Eligible Entry among each Participant Country that receives more votes through the Platform between the 1st and 8th of June 2021 will be selected as the Local Winner in each Participant Country.
    1. Local Winner must provide proof of age, country of residence and ownership of the Eligible Entry.
    2. The Local Winners will be published in the Platform on June 9th 2021.

 

  1. Global Winner Selection: The 4 Local Winners will compete among them as follows:
    1. The 4 Local Winners Entries will be posted in the Platform between the 10th and 15th of June 2021, during this period, simultaneously in the Platform, two (2) Local Winning Entries will face each other and the two (2) Local Wining Entries that receive more votes in each competition will be selected as the semifinalist.
    2. The Semifinalist will be published in the Platform on June 16th 2021
    3. The Semifinalist Entries will be posted in the Platform between the 16th and 23th of June 2021, during this period the Semifinalist Entries will face each other and the Semifinal Entry that receive more votes will be selected as the Global Winner.
    4. The Global Winner will be announced on June 24th 2021

 

  1. Global Winner Claim: The Global Winner has 5 days after notification to accept the prize. If the Global Winner does not accept the prize within this time period, the prize will be forfeited and the prize will be awarded to the other semifinalist.

 

  1. Voting process: People in any can subscribe and vote (The Voters) through the Platform for the Eligible Entry of is preference in each stage of the Competition.
  2. All Voters must be of legal drinking age or older (and if requested you must be able to provide proof of this)
  3. Voters shall subscribe maximum one time in the Platform. If the Voter subscribe more than one time, only the first will be accepted and all the others will be disqualified. Entries on behalf of another person will not be accepted.

  1. Intellectual Property : License of intellectual property rights in the registered Contents: by entering the Competition, each participant grants the Promoter a worldwide, perpetual, irrevocable, non-exclusive, transferable, royalty-free and sub-licensable license to use, reproduce, modify , adapt, publish or display (in whole or in part) any intellectual property right of the Content entered in the Competition, without the payment of royalties or other compensation, as part of the marketing or promotion of the Competition (including registration in the Competition website) on all known or unknown communication channels. This license will include the right to create derivative works of the entered Content and the right, at the sole discretion of the Promoter, to add additional logos, slogans and / or the Promoter’s intellectual property to the artwork entered in the Competition. Each Participant agrees not to assert any moral rights in relation to the use indicated above and warrants that they have full authority to grant such rights. If Content is included on the Competition website or used as part of the marketing or promotion of the Competition, it will be appropriately attributed to the entrant to the extent possible.

License of intellectual property rights of the Contents of the Local and Global Winners: As a condition for the delivery of the prize, each Local Winner and the Global Winner must grant the Promoter a worldwide license, perpetual, irrevocable, non-exclusive , transferable, royalty-free and sub-licensable to use, reproduce, modify, adapt, publish or display (in whole or in part) any intellectual property rights of the Content entered in the Competition, without royalties, payments or other compensations that do not be the prize, on all channels. This license will include the right to create derivative works of the entered Content and the right, at the Promoter’s sole discretion, to add additional logos, slogans and / or the Promoter’s intellectual property to the artwork. Each participant agrees not to assert any moral rights in connection with prior use and warrants that they have full authority to grant such rights. Additionally, local and global winners grant the Promoter the perpetual right to use their names, biographical information and any other information included at the Promoter’s discretion in relation to local and global winners and their entered Content.
  2. Participant’s License to Use the Promoter’s Intellectual Property: No right is granted to use the Promoter’s intellectual property rights for any purpose other than in connection with their participation in the Competition, that is, the inclusion of the Participant’s intellectual property in the Participant Entry. You are allowed to share the Content created on social networks, provided you clarify that it is your Content to participate in the Competition and provide a link to the website of the Competition.

Similar Content Enrolled: Participants acknowledge that other Participants may submit Content that may be similar to their own and that the Promoter may inadvertently develop future campaigns that may become similar to the Participant’s, consequently the participant waives request any compensation or right to negotiate with the Promoter on such matters.
  4. General: The Promoter is not responsible for the contents of the participants that are:

  9. The Global Winner’s name, country of residence and winning Content will be shared with anyone requesting the winner’s details, but no other information about the winner will be provided.
  10. Entrants shall warrant and indemnify the Promotor and the Pernod Ricard GroupÂŽs companies from any claims contrary to or in violation of these warranties.
  11. Entrants shall indemnify and hold the Promotor and the Pernod Ricard Group®s companies harmless from any and all claims, demands, causes of action and judgments (including attorney’s fees, court costs and expert’s fees) arising out of or relating to any breach by Entrants of these Official Rules, including any representations and warranties made herein.
  12. By entering this Contest, Entrants agree to sign and deliver to the Promotor and the Pernod Ricard GroupÂŽs companies upon its request any document necessary to enforce these Official Rules. Failure of Entrants to comply shall result in the immediate disqualification of the Entrants in the Contest.
  13. By accepting the Prize, the Winner of the Contest agrees that the Promotor and the Pernod Ricard GroupÂŽs companies shall not be liable for any loss or injury resulting from participation in the Contest, acceptance or use of any prize, or any travel related thereto.

 

  1. If for any reason the Contest is not able to be run as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes technical or not which corrupt, prevent or affect the administration, security, fairness, integrity or proper conduct of the Contest, the Promotor and the Pernod Ricard GroupÂŽs companies reserves the right, in its sole discretion and without any indemnification, to cancel, modify, postpone, extend or shorten the Contest in full or in part. Any modification related to the Contest will in particular be announced on the Platform.

  3. You acknowledge and confirm that Pernod Ricard may process your information, including information regarding identity and/or registration numbers, e-mail addresses, physical and/or postal addresses, telephone numbers and full names.

Limitation of liability and release No liability or responsibility is assumed by the Promotor and the Pernod Ricard Group®s companies resulting from Entrants’ participation in or attempt to participate to the Contest or downloading any information in connection with participation in the Contest.

No responsibility or liability is assumed by the Promotor and the Pernod Ricard GroupÂŽs companies for technical problems or technical malfunction which may affect the operation of the Contest, including but not limited to any of the following occurrences: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any email transmissions to be sent to or received; lost, late, delayed or intercepted email transmissions; inaccessibility of the Platform, in whole or in part for any reason; traffic congestions on the Internet or the Platform; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest, or loss, miscount, misdirection, inaccessibility or unavailability of an account used in connection with the Contest.
  6. The Promotor and the Pernod Ricard Group®s companies are not responsible: (i) for any errors or any inaccurate or incorrect data related to the Contest and (ii) for any use of the Recipes and Entrants’ Personal Information on any other support than the Platform.
  7. Use of any support other than the Platform is at user’s own risk. the Promotor and the Pernod Ricard GroupÂŽs companies are not responsible for any personal injury or property damage or losses of any kind which may be borne by user’s or any other person’s computer equipment resulting from participation in the Contest or the download of any information from any support other than the Platform.
  8. Promotor and the Pernod Ricard GroupÂŽs companies is not responsible for any attempt by any Entrants or other individual to deliberately damage or undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, which may be a violation of criminal and civil laws. Should such an attempt be made, the Promotor and the Pernod Ricard GroupÂŽs companies reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution.
  9. The Promotor and the Pernod Ricard GroupÂŽs companies failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.   10. This Contest is governed by the laws of MĂ©xico. By entering, Entrants consent to the jurisdiction and venue of the Mexican courts located in Mexico City for the resolution of any disputes.
  11. If it is determined that any of these clauses is illegal, invalid or unenforceable, it must be separated and eliminated from these terms and conditions and the remaining clauses will remain in force and will remain in full force and effect.
  12. Exemption from liability and compensation by Participants and Winners

1. What Personal Data do we gather about you and how do we collect it? Personal Data is collected only for the purposes set out in Section 3 below and each time you participate in any of the features or services offered by our Digital Media. The types and amount of information collected for the above-mentioned features and services may be updated and vary depending on the activities of Pernod Ricard. Subject to applicable law requirements, we may use a variety of technologies that collect and provide information about how our Digital Media is accessed and used by you. 6. Is your Personal Data sent to recipients located in other countries and why? Pernod Ricard is a global company and your Personal Data may be transferred across international borders. It may be transferred to countries that have a different level of data protection laws than the one existing in the country from where you submitted your Personal Data. Your Personal Data may also be transferred between different companies of the Pernod Ricard Group located in different countries. We will store the Personal Data that you sent us via our Digital Media in our databases as long as your account is active, for the duration of the contract with you or as needed to provide you the services you requested or to answer queries or resolve problems, provide improved and new services. We may also retain your Personal Data in accordance with our internal retention procedure as necessary to comply with our legal and regulatory obligations, resolve disputes and enforce our agreements. What are your rights regarding your Personal Data?

  • You can request the erasure of your Personal Data (i) if your Personal Data is no longer necessary for the purpose of the data processing, (ii) you have withdrawn your consent on the data processing based exclusively on such consent, (iii) you objected to the data processing, (iv) the Personal Data processing is unlawful, (v) the Personal Data must be erased to comply with a legal obligation applicable to Pernod Ricard. Pernod Ricard will take reasonable steps to inform the other entities of the Pernod Ricard group of such erasure.
  • You can request the restriction of the processing (i) in the event the accuracy of your Personal Data is contested to allow Pernod Ricard to check such accuracy, (ii) if you wish to restrict your Personal Data rather than deleting it despite the fact that the processing is unlawful, (iii) if you wish Pernod Ricard to keep your Personal Data because you need it for your defense in the context of legal claims (iv) if you have objected to the processing but Pernod Ricard conducts verification to check whether it has legitimate grounds for such processing which may override your own rights (v) if the data processing is based on the legitimate interest of Pernod Ricard.
